Terms and Conditions

1. General Terms

These Terms govern the use of the Ak44 platform and its Games (the Platform) and set the contractual framework for all participation, transactions, and communications between you and Ak44 Limited (the Operator).

By accessing, using or registering for an Ak44 account, you agree to be bound by these Terms, our Privacy Policy, Cookies Policy, and any additional rules applicable to the products available on the Platform. If you do not agree, you must not access or use the Platform.

Ak44 reserves the right to amend these Terms from time to time. Any changes shall take effect upon posting and shall apply to existing and future activity on the Platform. The game rules published on the Platform are incorporated by reference and you are responsible for understanding the theoretical payout percentage of each game.

Some Games may be unavailable in certain jurisdictions due to provider policies or regulatory restrictions, which may change without notice.

Ak44 Ltd is registered in Curaçao under registration number AC-000000, with registered address at 123 Oceanic Avenue, Willemstad, Curaçao. The Operator operates under a provisional licensing framework while regulatory approvals are in progress and subject to applicable Curaçao law and transitional arrangements. These Terms are effective as of 12.06.2024.

2. Obligations

1. You are at least 18 years old or meet the higher legal age of majority required by the laws of your residence, and you are legally permitted to participate in the Games on the Platform.
2. You participate in the Games strictly for personal, recreational, and entertainment purposes.
3. You participate in the Games solely on your own behalf and not for anyone else.
4. All information you provide to Ak44 during this agreement is true, complete, and accurate, and you will promptly inform Ak44 of any changes to this information.
5. You are solely responsible for reporting and paying any taxes on your winnings as required by the applicable laws.
6. All money deposited into your Account is not derived from any illegal activity and originates from legitimate sources.
7. You understand that participating in the Games involves the risk of losing the funds deposited in your Account.
8. You shall not engage in fraudulent, collusive, rigged, or other unlawful activity related to your participation or that of third parties, nor use software-assisted methods or hardware devices to influence outcomes. Ak44 may invalidate or close your Account or your participation in a Game if such conduct is detected.
9. You are prohibited from using any payment methods belonging to third parties. If security checks reveal a violation, winnings may be confiscated and the original deposit returned to the payment account owner. Ak44 is not responsible for funds lost from third-party accounts.
10. You may not transfer funds from your Account to other Players or receive funds from them, nor may you transfer, sell, or acquire User Accounts. This prohibition includes encumbrance, pledging, gifting, or any related arrangements with third parties.
11. If a wager is confirmed or a payment is made in error, Ak44 reserves the right to cancel such wagers or correct the entry to the terms that should have applied at the time.
12. If you discover errors or incompleteness in the software, you shall report them promptly. Failure to report may entitle Ak44 to seek full compensation for related costs.
13. If a Game malfunctions due to a system fault, Ak44 will refund the wagered amount to your Account or, if the Account no longer exists, compensate by an approved method. Accrued credits are handled analogously.
14. Ak44 reserves the right to reject or limit wagers and will not permit wagering that exceeds your Account balance. Winnings are credited to your personal Account.
15. Ak44 may terminate or modify any Games or Events offered on the Platform at its discretion.
16. Ak44 may require verification for suspicious or fraudulent transactions and may suspend or terminate Accounts accordingly.
17. The Software made available on the Platform is owned by Ak44 or third parties and is protected by copyright and related intellectual property laws. You may use the Software solely for personal, recreational purposes in compliance with these Terms and applicable laws.
18. All interactions on the Platform should be conducted with courtesy. Rude or obscene behavior, including in chat or support channels, is prohibited.

3. Account Registration

1. To place Wagers on the Platform, you must register and open an Account.
2. Each Player is limited to one Account per household, IP address, or device. Duplicate Accounts may be closed, and any associated deposits, winnings, or bonuses may be forfeited. Ak44 may reclaim such funds and require recovery of withdrawals upon request.
3. If you need to open a new Account, contact Support at [email protected]; the prior Account will be closed.
4. You must provide all mandatory information, including a valid email address. A valid email address is essential to recover access to your Account.
5. During registration you will select a username and password. You are responsible for maintaining the confidentiality of your login details. Ak44 is not liable for any misuse arising from disclosure of login credentials.
6. By registering, you agree to provide your legal name. Ak44 may verify the information and reserves the right to request supporting documentation. Changes to registered data may be restricted except in cases identified by Ak44 support, such as clerical errors.
7. Ak44 reserves the right to refuse registration or to close an Account. All virtual funds will be returned to your Account balance and all contractual obligations will be honoured.
8. Ak44 prohibits collusion and the use of automated devices or bots. Any gameplay resulting from such devices may be voided.
9. Residents of restricted jurisdictions or regions are ineligible to register. It is your sole responsibility to determine whether Ak44’s services are legal in your country of residence. Ak44 reserves the right to refuse service to any person or territory at its discretion.
10. Self-exclusion: If you request self-exclusion, Ak44 will close the Account and prevent further play. You remain responsible for disclosing any other Accounts you may hold; Ak44 will not be liable for losses incurred on other Accounts.
11. Employees, former employees of service providers, and related persons, including family members, are not permitted to register. Violation results in permanent closure and forfeiture of winnings; only the original deposits may be returned.

4. Account Issues

1. If you forget your password or suspect unauthorized access, you must report the matter promptly to Ak44.
2. Ak44 may declare a bet or transaction void, in whole or in part, if it determines, in its sole discretion, that any of the following have occurred: influence on outcomes; rule violations; criminal activity; material odds adjustments; bets placed during technical problems; or any error, misprint, or other fault affecting the offer or acceptance of bets.
3. If a deposit fee is flagged as insufficient by a blockchain or related service, Ak44 may confiscate winnings if the transaction is fraudulent.
4. If an Account is closed or suspended, Ak44 may close any future Accounts registered by the same person, device, address, or payment wallet. Wagers and transactions of the affected Account may be voided or canceled.
5. Ak44 offers two-factor authentication (2FA) as additional protection against unauthorized use. You are responsible for maintaining the confidentiality of your login details and ensuring that no other person can access your Account.

5. Deposit of Funds

1. You may participate in Games only when your Account has sufficient funds. Ak44 does not extend any credit.
2. From time to time Ak44 may credit a Bonus to your Account. The amount and terms of any Bonus are defined on the Platform. If a Balance contains both funds and an active Bonus, Bonus funds become available for wagering after the balance funds are expended. If the main deposit is withdrawn or the required turnover is not satisfied, Bonus funds and any related winnings are forfeited.
3. To deposit funds, you may transfer from your personal wallets or linked accounts. Minimum and maximum deposit amounts vary by payment method and will be displayed during the deposit process.
4. Ak44 is not a financial institution and shall not pay interest on any deposit.
5. Deposited amounts become available within a reasonable time after deposit confirmation. Withdrawals require prior deposit confirmation of all active balances.
6. Ak44 reserves the right to apply additional identity verification procedures (KYC) in processing deposits and to close an Account if documentation is not supplied. This may include a selfie with a document or identification material.
7. Players must provide genuine documentation for KYC. Fake or fraudulent documents will result in the confiscation of deposits and potential winnings.
8. Bonuses are subject to Bonus Terms and Conditions published on the Platform; customers should review these before claiming bonuses.
9. Deposits and payouts must be conducted using the account holder’s own payment methods. The name on the payment method must match the name on your Ak44 Account. If third-party deposits are detected, winnings may be forfeited and funds returned to the source.

6. Withdrawals

1. Withdrawals may be requested by the Account holder and must be made via a method registered to the Account.
2. All deposits must be wagered at least once before a withdrawal request is considered, in line with Ak44’s AML/CFT policies.
3. By using Ak44, you acknowledge and agree to comply with AML/CFT requirements applicable to your jurisdiction.
4. Withdrawals are processed within 48 hours of approval, subject to KYC/AML checks and compliance reviews.
5. Maximum payout limits are EUR 1,000 per day, EUR 3,000 per week, and EUR 15,000 per month, unless otherwise specified for progressive jackpots, promotions, or VIP arrangements.
6. Ak44 reserves the right to pay substantial winnings in installments or tranches where required by regulation or to manage large disbursements.
7. Withdrawal and deposit limits and any applicable fees are published in the Platform’s Help/FAQ section and may be updated from time to time.

7. Bonus Policy and Abuse Prevention

1. Bonuses are subject to separate terms, including minimum deposit, maximum bonus, wagering requirements (e.g., 35x), expiry dates, and product-specific restrictions as published on the Platform.
2. Bonus abuse and fraudulent activity are strictly prohibited. Examples include:
   1. Creating multiple Accounts to claim bonuses more than once;
   2. Using VPNs, proxies, or other location-masking tools;
   3. Colluding with other players to exploit promotions;
   4. Delaying gameplay or engaging in low-risk betting solely to satisfy wagering requirements;
   5. Using automated tools, bots, scripts, or sniping strategies;
   6. Chip dumping, gnoming, multi-accounting, or any activity designed to circumvent the intended use of the bonus;
   7. Any other strategy deemed abusive by Ak44 in its sole discretion.
3. Ak44 may withhold or remove bonuses and associated winnings if abuse or fraud is suspected or identified.

8. Fair Play and Game Integrity

1. All non-live games are powered by certified Random Number Generators (RNGs) to determine outcomes.
2. Ak44 conducts or commissions third-party audits to verify fairness and transparency of game results.
3. Players may request official Return To Player (RTP) values for specific games.

9. Account Dormancy and Closure

1. Where applicable, Ak44 monitors dormant accounts and may impose administrative measures in accordance with regulatory requirements.
2. If there is no login or activity for an extended period, Ak44 may contact the account holder and, after a defined notification period, apply a monthly administrative fee or close the account in compliance with applicable laws.
3. Upon closure, all remaining balances will be settled in accordance with the Platform’s withdrawal policies.

10. Data Protection and Privacy

1. Ak44 is committed to protecting your privacy and personal data. Personal information is processed in accordance with the Platform’s Privacy Policy and applicable data protection laws.
2. Security measures are implemented to safeguard data against unauthorized access or use.
3. By using the Platform, you consent to the collection and processing of your data as described in the Privacy Policy.

11. Technical Errors, Aborted Games & Liability

1. If a game is interrupted due to technical issues, affected bets remain pending and will be resolved in accordance with the game rules.
2. Ak44 provides the Platform and its services on an “as is” and “as available” basis. Ak44 excludes liability for losses, damages, or interruptions caused by technical failures, cyber incidents, or third-party service disruptions beyond its reasonable control.

12. Communication & Amendments

1. By using the Platform, you consent to promotional communications. You may opt out at any time through the available mechanisms on the Platform or by contacting Support.
2. Ak44 may update these Terms at any time. It is your responsibility to review the latest version on the Platform.
3. The most current version of these Terms will be maintained on the Platform and supersedes all previous versions. Continued use following amendments constitutes acceptance of the updated Terms.

13. Customer Support and Disputes

For inquiries, disputes, account closures, or requests for responsible gambling tools, contact Support at [email protected]. Ak44 will endeavour to respond promptly and resolve issues in a transparent manner. This Agreement is governed by the laws of Curaçao. Any disputes shall be resolved in the competent courts of Curaçao, or as otherwise required by applicable law. Ak44 may engage payment agents or service providers to facilitate deposits and withdrawals, with appropriate disclosures available upon request.
